Litigious divorce

Within the sphere of judicial divorce, when a consensual divorce is not possible, the litigious divorce proceeds. It consists of divorce where there is disagreement on issues arising from the divorce process, such as division of assets. Usually, in a litigious divorce, parental issues, such as custody and spousal support, are not addressed as part of the same process as that of divorce, but are dealt with in other processes so that there is no procedural turmoil.
