Judicial Trustee (Article 84, § 3, of Law 13.146 / 2015)

Guardianship or interdiction comprises a legal act in which a person is declared incapable of managing his civil life. Once the incapacity for the acts of civil life of the interdict is verified, the plaintiff of the action will be appointed curator of the incapacitated. Causes such as serious illnesses or disabilities that prevent the person from expressing their will can be banned. The curator must administer the property and income of the interdict, as well as provide care for the interdict. It must also report to the judiciary, under the supervision of the Public Prosecutor. The trustee is always declared by court order, requiring different essential expertise and legal counsel.
